We are getting a lot of questions about the new ATF Guidance. Unfortunately currently as of today Oct 10th, we still cannot transfer a suppressor or SBR on a Form 4473 under Georgia Law. Here is the official Georgia Statute:
O.C.G.A. § 16-11-122: Prohibited Possession
• Restricted Items: It is illegal to possess a sawed-off shotgun, sawed-off rifle, machine gun, silencer (suppressor), or other dangerous weapon (such as a bomb, mortar, or rocket launcher).
• Exception: Possession is only legal if it falls under the statutory exemptions outlined in O.C.G.A. § 16-11-124.
O.C.G.A. § 16-11-124: Exemptions: National Firearms Act (NFA) Compliance: Items legally registered and possessed in compliance with the federal National Firearms Act (26 U.S.C. §§ 5841-5862)
Until GA Law changes or the attorney general of GA says otherwise, it is still business as usual.
